Photo Usage Terms

The use of images, videos and logos from the Danube Tower media download is subject exclusively to the following photo usage terms. By downloading or using the provided content, users accept these terms.

Authorised Users

The Danube Tower media download is intended exclusively for agencies, journalists, press representatives, employees of media companies and authorised partners.

The Danube Tower grants these users a free licence to use the provided images, videos and logos, provided that they are used exclusively for promoting or reporting on the Danube Tower.

Rights to Images, Videos and Logos

Donauturm Aussichtsturm- und Restaurantbetriebsgesellschaft m.b.H., hereinafter referred to as “Danube Tower”, holds the copyright exploitation rights to the provided images, videos and logos, hereinafter referred to as “content”.

All content from the media download is protected by copyright. Downloading or using the content does not grant users ownership rights, copyrights, trademark rights or any further usage rights to the content.

Scope of the Usage Licence

Unless otherwise agreed in writing, the usage licence is:

• free of charge,
• limited in time,
• non-exclusive,
• non-transferable,
• intended exclusively for promoting and reporting on the Danube Tower.

Free use of the provided content is limited from the date of download until 31 January 2027.

Permitted Use

The content may only be used in connection with the Danube Tower, in particular for editorial reporting, press work, promotion, tourism communication and partner-related communication about the Danube Tower.

Any use beyond this must be agreed with and approved in writing by the Danube Tower in advance.

Prohibited Use and Transfer

Unauthorised transfer of the content to non-authorised third parties is not permitted.

The content may not be altered, edited, redesigned, manipulated or used in a misleading context. Any use that infringes copyrights, name rights, trademark rights or other rights of the Danube Tower or third parties is also prohibited.

For every publication or other use of the provided content, an image credit must be placed directly below or next to the respective content.

Changes and Revocation of Use

The Danube Tower reserves the right to amend these usage terms at any time.

The Danube Tower may restrict, terminate or revoke the use of the media download or individual content at any time and without stating reasons. Users shall not derive any claims against the Danube Tower from this. There is no entitlement to access the media download.

Liability and User Responsibility

Users are liable for all damages resulting from unlawful, unauthorised use or use that violates these terms.

Any third-party claims arising from such use shall be borne by the users. Users shall indemnify and hold the Danube Tower harmless in this respect.

Any liability of the Danube Tower for direct or indirect damages, loss of profit, data loss, consequential damages or damages arising from third-party claims is excluded.

Misuse of the Media Download

By accepting these usage terms, users undertake to refrain from any misuse of the media download. In particular, users may not bypass security measures or access restrictions.

In the event of unlawful conduct, the Danube Tower reserves the right to claim damages.

Governing Law and Jurisdiction

These usage terms are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The place of performance and exclusive place of jurisdiction for all claims arising from or in connection with these usage terms is Vienna.

Severability Clause

Should individual provisions of these usage terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be interpreted or supplemented in such a way that the economic purpose associated with it is preserved as far as possible.
